Land Use Application Appeals

There is a 12 day period of time where an Appeal of a decision made by either the Washington County Director of Land Use and Transportation or the Hearings Officer can be filed with the Current Planning Division.  

The applicant, or property owner can file for an Appeal of a Type I decision.

In the case of a Type II Application the decision can be appealed by the applicant, or by a neighbor who had been notified of the application and had submitted a comment.  Appeals of Type II Applications shall be heard by the Hearings Officer.

In the case of a Type III Application the decision can be appealed by the applicant, someone who had been notified of the application and submitted a comment, or by someone who showed up to the Public Hearing.  However, Appeals of Type III applications are heard by the State of Oregon Land Use Board of Appeals (LUBA).

Any part of a land use decision by the County can be appealed.  This includes the entire decision to approve or deny, or one of the specific conditions of approval.  Instruction on how to file an appeal can be found on the Appeal Information form.
